1. General Terms
  • 1.1 Agreement: These Terms and Conditions form a legally binding agreement between you (the “Client”) and Samui-Childcare (“we”, “our”, or “the Company”), providing the terms under which we offer our childcare services.
  • 1.2 Service Availability: Samui-Childcare provides childcare services in Koh Samui. Availability of services may vary based on demand and location.
  • 1.3 Changes to Terms: We may update or change these Terms and Conditions at any time. We will notify you of any changes by updating the “Effective Date” at the top of this page. It is your responsibility to review these terms periodically.
2. Booking and Service Terms
  • 2.1 Service Requests: To book any of our services, the Client must complete the online booking form, providing accurate and complete information. By submitting the form, you are confirming your interest in booking our services.
  • 2.2 Service Confirmation: All bookings will be confirmed by Samui-Childcare via email. Confirmation is subject to availability and may require additional communication.
  • 2.3 Cancellations and Refunds:
    • 2.3.1 Cancellations: Cancellations must be made at least 24 hours in advance for hourly bookings, and at least 48 hours in advance for daily or longer-term bookings to avoid cancellation fees.
    • 2.3.2 Refunds: Refunds for services will be provided only if the cancellation occurs within the specified time frame. No refunds will be given for cancellations made after this period.
  • 2.4 Service Changes: Any changes to the service (e.g., extended hours, change in caregiver, etc.) must be communicated to us at least 12 hours in advance, and are subject to availability.
3. Payment Terms
  • 3.1 Payment Method: Payments for our services can be made via credit card, bank transfer, PayPal, or other payment methods as offered by the Company.
  • 3.2 Payment Due: A deposit may be required to secure booking, with the balance due before or on the day of the service.
  • 3.3 Late Payments: If payment is not received on time, we reserve the right to cancel the booking or delay services until full payment is received.
  • 3.4 Fees: The prices for our services are clearly listed on the website and are subject to change. Any additional fees, such as overtime charges or transportation costs, will be communicated before booking or during the service.
4. Client Responsibilities
  • 4.1 Accurate Information: You agree to provide accurate and complete information when booking services, including any special requests, child’s medical information, allergies, and any other relevant details.
  • 4.2 Supervision: While Samui-Childcare nannies provide excellent care, the Client retains responsibility for the safety and well-being of their children at all times. The nanny will not be responsible for the child’s health, safety, or discipline beyond the agreed-upon services.
  • 4.3 Respectful Behavior: The Client is expected to treat Samui-Childcare staff with respect. Any form of verbal, physical abuse, or inappropriate behavior towards the nanny may result in immediate termination of services, without a refund.
5. Nanny Responsibilities
  • 5.1 Professional Care: All nannies are qualified, experienced, and vetted for their role. They are trained in CPR and first aid and are dedicated to providing a safe, fun, and educational environment for the children.
  • 5.2 Communication: Nannies are required to communicate effectively with the Client regarding the child’s needs, preferences, and any changes in routine.
6. Limitation of Liability
  • 6.1 Liability: Samui-Childcare shall not be held liable for any injuries, damages, or losses that occur during the course of the childcare services. While we take all necessary precautions to ensure your child’s safety, we are not liable for any accidents or injuries.
  • 6.2 Force Majeure: Samui-Childcare is not responsible for failure to perform any obligations under these Terms and Conditions due to events beyond our reasonable control, including but not limited to natural disasters, government regulations, strikes, or power outages.
7. Confidentiality and Data Protection
  • 7.1 Personal Information: Samui-Childcare will respect your privacy and will only use your personal information in accordance with our Privacy Policy. We do not share your personal data with third parties except as necessary for providing services or complying with the law.
  • 7.2 Confidentiality: We ensure that all information about you and your children remains confidential, including sensitive health or behavioral information. This information will only be shared with the assigned nanny if necessary for the provision of services.
8. Intellectual Property
  • 8.1 Ownership: All content on the website, including text, images, graphics, logos, and trademarks, is the property of Samui-Childcare or our content providers and is protected by copyright laws. You may not use, reproduce, or distribute any content from the website without written permission from Samui-Childcare.
9. Dispute Resolution
  • 9.1 Mediation: In the event of any dispute arising between the Client and Samui-Childcare, both parties agree to attempt to resolve the issue through informal mediation before resorting to legal action.
  • 9.2 Governing Law: These Terms and Conditions will be governed by and construed in accordance with the laws of Thailand. Any disputes will be subject to the exclusive jurisdiction of the courts of Koh Samui.
10. Termination of Services
  • 10.1 Termination by Client: The Client may terminate the services at any time by providing written notice to Samui-Childcare. Termination will be subject to the terms of cancellation and refund policies.
  • 10.2 Termination by Samui-Childcare: Samui-Childcare reserves the right to terminate services if the Client fails to comply with these Terms and Conditions, behaves in an abusive manner, or if the nanny’s safety is at risk. In such cases, no refund will be provided.
